第３部では、AIの学習プロセスへのフェアユースの適用とAI学習のためのライセンススキームの可能性が検討されている。
多くの場合、AI学習のための著作物の利用は変容的（トランスフォーマティブ）な利用であると考えられるだろうが、最終的にフェアユースが成立するか否かは、生成AIのアウトプットが市場において、利用された著作物を代替するか否かに依拠するだろうと本レポートは述べる。米国で係属中のAIの学習をめぐる著作権侵害訴訟におけるフェアユースの分析に対する本レポートの影響が注目される。
また、本レポートは、AI学習のための法定許諾・拡大集中許諾・オプトアウトは時期尚早だと結論づけている。なお、最終バージョンは、このドラフトにおける分析や結論が大きく変更されることなく発行される見込みである。
On May 9, 2025, the U.S. Copyright Office released a pre-publication version of its report on Copyright and Artificial Intelligence (Part 3).
Part 3 examines how the fair use doctrine may apply to the process of AI training and the feasibility of licensing schemes for AI training.
The Report states that the use of copyrighted works for AI training is likely to be transformative uses in many cases but the final determination of fair use will depend on whether the output of the generative AI supplants or supersedes the copyrighted works used for AI training in the market. It is worthy of attention how the Report may have impacts on fair use analysis in the pending copyright lawsuits in connection with AI training in the US.
Further, the Report concludes that statutory license, expanded collective license, and opt-outs for AI training are premature. The final version is expected to be issued without substantial changes in the analysis or conclusion described in this draft.
